Lagos State Urban and Regional Planning & Development Law mandates anyone who wants to build any structure in Lagos to first of all get their Building Permit and Authorization to Commence Construction Letter before starting anything on the site.
The building permit doesn't require a Certificate of Occupancy (C of O) anymore to obtain. This has made it more easy for more people to start the approval process easily and get their building permit faster. The documents required to kick start your building approval are; Survey Plan and Architectural Drawings.
Once you have these two documents then you can follow these steps to obtaining a Building Permit from Lagos State Physical Planning Permit Authority (LASPPPA) in your district.
1. Submit Your Architectural Drawing & Survey Plan for Vetting
You will need to visit the district office of LASPPPA in your area where your site is located, then present your drawing and survey plan for vetting. Your architectural drawing has to be signed, sealed and stamped by a registered architect before it can be checked for compliance with proper design standard adopted by Lagos State for different structures and Land area.
Your survey plan will also have to be vetted to check if its free from government acquisition i.e. if the land has not be earmarked for government-sponsored development in the future. If your architectural drawing is free from any error or irregularities and your survey plan is free from government acquisition, this will be noted on the documents, only then can you proceed to the next step.
2. Site Inspection & Assessment Fee
Once your Architectural drawing and survey is checked ok, an officer from the district office of LASPPPA will have to visit your site for confirmation if its vacant or the drawing presented is as you have built (this is if you are seeking building permit for an already built structure or ongoing construction). Once the officer finds everything in order, you would be given a calculated assessment fee to be paid into government account, this fee would include; building plan fee, stage certificate fee, developmental fee and penal fee (for as-built structures).
Once you have made payment, you will have to produce the original receipt of the payment and copies of;
- Land Receipt or Title Document
- 2 Recent Passports
- Structural drawings (for a storey building and above)
- Mechanical & Electrical Drawing (for structures above 2floors)
- Affidavit in lieu of land use
- Land Use Planning Analysis Report
- EIA/TIA Report (for commercial structures)
3. Registration Number & Tax Clearance
Once all your documents and payment receipts has be properly filed, you would be given a file number which will be your building registration number. Then your file will proceed to LIRS office from LASPPPA office for tax payment verification and tax charges/clearance. If you have been paying adequate tax to the Lagos State Government your tax record will either exempt you from paying any tax and be cleared or you would have to pay a token as tax.
If you have not been paying tax to either Lagos State Government or Federal Government, a 5years tax will be calculated for your property and you would be have to pay that before you can be cleared for tax and allowed to receive your building permit.
4. Provisional & Final Approval
Once you have been cleared for tax and all document has been duly checked, the district office at the LASPPPA will then issue your property a provisional building approval, that is if you haven't obtained and submitted a Certificate of Occupancy (C of O) during the documentation stage. If you have submitted your C of O, then a final approved will be granted to your property.
What Next...
Once you have your approved building permit, you are to proceed to LASBCA office in your district to obtain a letter of Authorization to Commence Construction. This gives you authorization to move to site to commence construction and also allows officers of the agency to commence a stage by stage inspection and certification of your building construction by issuing you a Green Sticker and also a Certificate of Completion and Fitness For Habitation.
